Information about Mayflower Place Condos

Owners who rent their units to tenants must provide the trustees and the property management firm contact information for the tenants including their names, addresses and phone numbers. In addition, upon tenant rollover, owners must provide this information for all new incoming tenants.

At their discretion, owners may allow their tenants to access the information referred to herein directly. However, although both owners and tenants are referenced in this document, it is the owner’s responsibility to ensure that their tenants comply.

  • Each unit owner and/or tenant shall have one laminated visitor's parking pass to hang from the rearview mirror plus one laminated resident’s parking pass to hang from the rearview mirror of their car (or of another car, in the event they do not have a car). Owners and/or tenants of duplex units that have two assigned parking spaces shall have two resident parking passes. The passes include an identifiable number, consisting of the last digit of the building number plus the unit number. For example, the resident’s parking pass number for 229 Freeman Street #1 is "91".

  • If you are a resident and you find another unit owner's and/or tenant's car (identifiable by the resident’s or guest parking pass) in your parking space, you must first contact the other unit owner and/or tenant to inquire about the temporary situation. If you do not know their contact information, call the Trustee on Call for that month. If you have tried and cannot directly reach the other unit owner and/or tenant or the Trustee on Call, then please give the other owner and/or tenant the benefit of the doubt and try to find temporary parking for your car on the street in the interim. If you receive no response from the other unit owner and/or tenant or Trustee on Call by 10pm, you may then attempt to have the other resident’s car towed.

  • If you are a resident and you find an unidentifiable car (no resident's or guest parking pass) in your parking space, you can try to find temporary parking for your car on the street in the interim. Alternatively, you should try contacting Brookline Police to possibly identify the car or owner. If this course is unsuccessful, you may then attempt to have the unidentifiable car towed after 15 minutes.

Towing:

  • If you have no alternative but to tow a car out of your space or a reserved guest space, please call Robert’s Towing at (617) 782-2525. They are located at 25 Goodenough Street, Brighton, MA 02135. (FYI – Robert’s Towing also owns Brookline Towing, which is located at 100 Hano Street, Allston, MA 02134.)

  • The person calling for the tow - whether unit owner or tenant - must prove that he/she has an exclusive easement to use or lease the space from which an unauthorized car is towed, and may be subject to lawsuit in the event the owner of the towed car believes he/she has been wrongfully towed.

  • The tow company is supposed to register the towing event with Brookline Police. Therefore, if your car is missing, you can try contacting Brookline Police to determine where to retrieve your car, in exchange for a towing fee which must be paid in cash to the tow company.

Recourse:

  • If you are a resident and your car has been wrongfully towed from your assigned space, you will need to write a letter describing the situation (including which company towed the car, who authorized the tow company, the towing company’s proof of such authorization, proof that you are the exclusive user of that parking space, etc.), attaching a copy of the tow slip, and mail it as follows:

  • This type of trespass towing situation is governed by Chapter 266: Section 120D of the General Laws of Massachusetts (http://www.mass.gov/legis/laws/mgl/266-120d.htm). In addition, the rates for towing of motor vehicles is governed by the Code of Massachusetts Regulations Title 220: Section 272 (http://www.mass.gov/Eoca/docs/dte/cmr/220cmr272.pdf). In order to recover the cost of a wrongful towing, the owner will have to take the towing company to court.
